BN’s Joseph Mauh has been caught red-handed on a double election cheat.  He not only promised a poor Headman RM 10,000 to gain his vote, but then the cheque bounced!

In this way Mauh cheated his constituents twice.  Firstly he cheated them of their right to a free vote by bribing the Headman, which is an exceedingly serious crime.  Secondly, he didn’t even carry out his promised payment to a poor community.

You could say that a person who takes a bribe in exchange for their most precious freedom, the freedom to choose their rulers and law-makers, deserves what they get.  But, of course such communities agree to these bribes because the treacherous BN government has kept them so poor and desperate.

The police must act to arrest election criminals

Sarawak Report assumes that, now this incontrovertible evidence has been placed before them, the police will move immediately to detain and question Joseph Muah.  Likewise, the Election Commission should suspend the result of the election.

If the evidence is proved (and it should be done quickly) then there should be a re-election.  In the light of this abuse, other similar claims across the length and breadth of Sarawak should also be investigated.  We are not talking about ‘opposition troublemakers’ we are talking about a respected and appointed Headman, who voted for BN!

Joseph Muah, if found guilty,faces the most serious criminal charge of election fraud.  This is the testimony of the Headman against him:

“My name is Kuching ak Moyan and i am one of the headmen in Tamin constituency. In the just concluded State election, i was given three cheques, one for RM2,000, another for RM3,000 and the third for RM5,000 by the Barisan Nasional candidate, Joseph Mauh.  I have cashed out the first two cheques, both for a total RM5,000 but the last one, for RM5,000, was bounced. So i sent it back to him and he promised that he will bank in the amount instead into my account. Up till today, i have not received the RM5,000. The three cheques were given to me on the 13th of April so that we will give our support to the Barisan Nasional. In the year 2006 State election, each voter here was given only RM20 but in this election, the amount was increased to RM50 per voter. There are 15 voters in this longhouse and all of them were given RM50 each. I think all of us have voted for Barisan Nasional. Ofcourse I know that the money the Barisan Nasional give to us would amount to nothing if the government grabbed our land. But what to do, we still have to vote for the government as the government has given us the money. Yes, i know we can just accept the Barisan Nasional money and vote for the opposition but since everybody else voted for Barisan Nasional this time, i decided to follow suit.”

Time to stop Sham Elections in Sarawak

This is just the beginning of the evidence about this election.  No wonder BN in KL was so worried about the election and so relieved at the outcome.  But likewise, no wonder Taib rushed in the middle of the night in the middle of the weekend to the Governor to get sworn back in before anyone could shout “Stop Thief!”

But if he hopes this is the end of the matter then the Chief Minister is older and stupider than even we realised.  The cheated voters of Sarawak are not going to take this sitting down.  Because the victory of this last election was that, despite the bullying, bribes and cheating, the opposition still managed to gather 45% of the vote!

Imagine what percentage would have gone to the opposition without the rigging and cheating and bribes?  The swings across the country were HUGE and they were away from BN in town and rural areas alike.

Imagine what the percentages would have been if all those half million native voters who Taib refuses to give voter registration to had been able to vote too?  This is why BN is worried.  They are an illegitimate government who stole the election and they deserve to be investigated and prosecuted and then punished with the full force of the law.

Sarawak Report is currently in Geneva, where this NGO is joining others who have been invited to speak at the UN about the problems over human rights and democracy in Sarawak.  We will present the case of this Headman and also the many others who have been cheated in this election.

  1. I have long given up hope on the dayak constituencies as we can see here the headmen receiving bribes. Had the last payment was honoured, they won’t be news at all. Think about the rich YBs like Jabu, Masing etc , obviously they have the money to honor that vote-buying.

    The headman should have held the cheque but instead return it to the owner. So naive and honest. He should have lodged a Police report. Bounced cheque is an offence,tantamount to cheating and it is a white collar crime.

    SPR should declare the result as NULL and VOID..a re-election must be called within 14 days from date of report. Anyone will concrete evidence like Mr Kuching should come forward and testify.But since he has surrendered the cheque to YB,he can denied it. Our PKR learned YBs can proceed with the case. There are many many more to come. I do hope that justice prevails. This is a bitter lesson for the Tuai rumah and his anak biak and hope that other dayaks wake up from deep slumber now.

      There should be bank transaction record for the past two checks. Joseph Muah, so what he’s a YB. You played dirty in the election, there are people who knows the rules. It’s not zaman dulu.

    Both the State Parliamentary Member and the Headman should be investigated for involvement in bribery. Kalau nak sangat fight for Jusitice and Integrity, biarlah impartial. Jangan ingat dok highlight jer keburukan satu pihak yang merasuah, pihak yang terima rasuah tu pun sama jugak buruknya. Yang korang ni buat kerja pun separuh jer, report pun biased giler ke arah pembangkang. Nu headman tu pun mesti repot jugak kat polis, siap mengaku lagi terima rasuah.

    Justice and Integrity do not pick sides.

    Another way of vote rigging, told by voters in DUN Tupong. A voter will mark ‘X’ beside the BN logo on the polling ticket. Next, he would cautiously take out his mobile phone with camera from his pocket, snap at the polling ticket, fold the ticket and put it in the polling box. After leaving the polling centre he would meet a BN agent, had his name check and RM1,000 changed hands!
    Many of the youngsters who registered as new voters about one or two years ago could not find their names in the Election Voters List, hence they were deprived of voting during the recent PRN. They told that the village Headman collected their names because he wanted to register them as new voters. When asked for the copy of voters registration form, they seemed not to know anything about that. Tupong lost a large number of potential new, young voters! Something must be done immediately by PR in Sarawak in order that the same flaws and mistakes are not repeated in the coming GE.

    First the headman already accepted the cheque. So what to report about this issue. They already elected BN’s Joseph Mauh to state assembly. The Headman should report to the opposition regarding this issue instead he cash in the money & distributed the money RM50 each to each voter. How about the remaining cash? Wah that RM50 can last for 5 years. There is not such thing as follow suits.

      The issue is mere gratification which is an offence under the law. If you want to hook/implicate YB Joseph Mauh, first and foremost lodge a reports to the MACC and/or Police . They could use MACC Act 2009 and the penal Code. Remember when YB Joseph first approached the Penghulu , there are other witnesses who had heard the conversation which gives rise to the corroboration of oral evidence by these other witnesses. Then come the documentary evidence of cheques. Other evidence shall include the transactions from the bank who had authenticated when the cheque was cashed and who had found out one of the cheque was dishonoured. When these happened, other long house folk was also aware of the incident. Thus it will vouch corroboration under section 157 of the evidence Act 1952. TheMACC or the Police will know what to do. When you make reports, ensure accompanied by counsels. Thus it, a prima facie case would be made out . Joseph will investigated.

    Look at what happened in Batu Kawa Constituency and Sanadin Constituency vote count… Obviously the oppositions were winning by hundreds.. than suddenyl one polling bag got missing and the other venue experienced black out. Obviously the Beer End governement are desperate. If they lose the state, those previous YBs who have been cheating and swindling the rakyats money will surely have to go to face the music.

    BNs elected YBs are scared… They are terrified of the outcome of this election. Obviously the opposition made great advances in the rural areas. With better monitoring during the campaign period and etc, we will definitely see a better light in the coming GE. Hidup Pakatan!!!!!!

      This scenario was similar to that happened at Pantai Damai polling centre in 1999 . The PKR candidate, Ustaz Usaini was leading all the way and in a matter of seconds, it will show the obvious actual result. Then, suddenly, out of sudden, a black out happened and chaotic situation existed and there were reported that boxes were moved away. The PKR personnel did not know what to do when it happened. Then when the electricity was restored, the next counting only show PBB was the suspicious winner. The people had been talking for months about it but what to do, BNN still wins

    Both Joseph Muah & Kuching Moyan are guilty. One for bribing during the election & the other one for receiving the bribe during the election.

    Thanks to SR team who are currently in Geneva fighting for Sarawakian’s justice. Shame on Sarawakians (especially the Dayak people) who are still blind, selling their votes for the sake of money & goodies given by BN.

    Kuching ak Moyan, you are cheapskate & the likes of you will only bring shame to Iban people….!!!

    Continue giving excuses for these useless, unprincipled and immoral bribe receivers, and Sarawak will remain BN’s fixed and permanent deposit. All the votes for anti-BN parties by urban voters are effectively wasted. Even if 100% urban votes go to PR, BN will still win.

      Also the Government depts I mean ALL departments and gone were the days
      when everything is so smooth and everyone is helpful. Nowadays if you walk into any government dept I wish that I don’t have to do anything with them.You will see 5S here and there but they are always having meetings,meetings,meetings all the time.If NOT meeting,KURSUS. Does that means government servants these days are so incompetent???
      If the government is corrupt,then the TUAI Rumah, Ketua Kaum, Penghulu and Pemanca are ALL corrupt too as these people are appointed by them(District Office)

      What about the submarine commission of RM493 million?? RPK is NOT a judge and how come he clears anyone of such crime??
